GENERAL CONDITIONS OF CARRIAGE

SLM’s General Conditions of Carriage for passengers and baggage (“General Conditions of Carriage”) shall be applicable. These General Conditions of Carriage are available from SLM and its authorized agents free of charge and can be viewed on-line at www.flyslm.com or will be sent to you upon first request. To the extent any provision or notice contained or referred to herein is contrary to any of the provisions in the General Conditions of Carriage, the General Conditions of Carriage take precedence.

DENIED BOARDING, CANCELLATION AND DELAYS

SLM takes all necessary measures to avoid delays, cancellations or denied boarding. However, in the event you are denied boarding, your flight is cancelled or delayed for minimum of two hours, SLM shall offer compensation and assistance depending on the specific situation.

IT IS FORBIDDEN TO CARRY WITH YOU ANY DANGEROUS GOODS

These goods include:

  • explosives*
  • compressed gasses (incl. aerosols)
  • flammable liquids
  • substances with a high oxygen content, e.g. peroxides and bleaching powder
  • toxic substances
  • radioactive substances
  • corrosive substances
  • magnetic, harmful or malodorous substances and irritants

* Ammunition for sporting purposes may only be carried with the airline’s permission.

It is forbidden to carry any firearms, replicas of weapons, daggers, (flick) knives, pointed/edged weapons, sharp objects, blunt instruments, lighters and other offensive looking articles on your person or in hand baggage. It is also forbidden to use electrical devices, which could interfere with the aircraft’s radio and navigation equipment, e.g. radios and portable telephones.


NOTICE OF BAGGAGE LIABILITY LIMITATIONS

Liability for loss, delay, or damage to baggage is limited unless a higher value is declared in advance and additional charges are paid. For most international travel (including domestic portions of international journeys), the Montreal Convention will apply, with a liability limit of 1.288 Special Drawing Rights (approximately €uro 1,600. = or US$1,800. =) for checked and unchecked baggage. In some cases, the (amended) Warsaw Convention may apply, with a liability limit of approximately US$ 20.00 per kilogram for checked baggage per passenger.

The carrier assumes no liability for fragile, valuable or perishable articles in the checked baggage. Furthermore, the carrier is not liable for damage to, or delay in the delivery of, fragile or perishable articles, money, jewelry, silverware, negotiable papers, securities or other valuables, samples or business documents, which are included in the passenger's checked baggage, whether with or without the knowledge of Carrier.

The carrier will also not accept liability in the following: Loss of projecting components of a baggage such as wheels, pull-strips, handles nor for damage such as scratches, scuff marks, dents and cuts. Damage to wheels, handles, locks, zippers, pull straps or for damage due to over packing and manufacturer’s defects.

FOUND AND UNCLAIMED CHECKED BAGGAGE

Found and unclaimed baggage which can be assumed to have been checked shall be taken into the local lost and found (LL) office for identification. If no claim is made for the baggage by a passenger within 120 hours after the baggage was found, the baggage shall be sent to the carrier's own central baggage tracing office. Where the baggage is held by the carrier responsible the baggage shall be retained for a minimum of ninety (90) days pending further enquiries before it is disposed of.

ADVICE TO INTERNATIONAL PASSENGERS ON LIMITATION OF LIABILITY

Passengers on a journey involving an ultimate destination or a stop in a country other than the country of origin are advised that the provisions of the (amended) Warsaw Convention, or the Montreal Convention may be applicable to the entire journey, including any portion entirely within the country of origin or destination. These Conventions may limit the liability of carriers for death or bodily injury, and for baggage loss, delay or damage. Many air carriers, including all European Community air carriers, have waived the (amended) Warsaw Convention limits for death or bodily injury and the defence that they have taken all necessary measures to avoid the damage for the first 128,821 Special Drawing Rights of any such claim. Additional protection can usually be obtained by purchasing insurance from a private company. Such insurance is not affected by any limitation of the carrier’s liability under the (amended) Warsaw Convention or the Montreal Convention. CONDITIONS OF CONTRACT

1. As used in this contract ‘ticket’ means this passenger ticket and baggage check, or this itinerary/receipt if applicable, in the case of an electronic ticket, of which these conditions from part, ‘carriage’ is equivalent to ‘transportation’, ‘carrier’ means all air carriers that carry or undertake to carry the passenger or his baggage hereunder or perform any other service incidental to such air carriage, ‘electronic ticket’ means Itinerary/receipt issued by or on behalf of Carrier, the Electronic Coupons and, if applicable, a boarding document. ‘WARSAW CONVENTION’ means the Convention for the Unification of Certain Rules for International Carriage by Air signed at Warsaw, October 12, 1929, or that Convention as amended at The Hague, September 28, 1955, whichever may be applicable, ‘Montreal Convention’ means the Convention for the Unification of Certain Rules for International Carriage by Air signed at Montreal, 28 May 1999.

2. Carriage hereunder is subject to the rules and limitations relating to liability established by either the (amended) Warsaw Convention, or the Montreal Convention unless such carriage is not ‘international carriage’ as defined by any of the aforementioned conventions.

3. To the extent not in conflict with the forgoing, carriage and other services performed by each carrier are subject to: (i) provisions contained in the ticket, (ii) applicable tariffs, (iii) carrier’s conditions of carriage and related regulations which are made part hereof (and are available on application at the offices of carrier), except in transportation between a place in the United States or Canada and any place outside thereof to which tariffs in force in those countries apply.

4. Carrier’s name may be abbreviated, in the ticket, the full name and its abbreviation being set forth in carriers tariffs, conditions of carriage, regulations or timetables; carrier’s address shall be the airport of departure shown opposite the first abbreviation of carrier’s name in the ticket; the agreed stopping places are those places set forth in this ticket or as shown in carrier’s timetable as scheduled stopping places on the passenger’s route; carriage to be performed hereunder by several successive carriers regarded as a single operation.

5. An air carrier issuing a ticket for carriage over the lines of another air carrier does so only as its Agent.

6. Any exclusion or limitation of liability of carrier shall apply to and be for the benefit of agents, subcontractors, servants and representatives of carrier and any person whose aircrafts is used by carrier for carriage and its agents, servants and representatives.

7. In case of damage to baggage moving in international transportation complaint must be made in writing to carrier forthwith after discovery of damage and, at the latest, within seven days from receipt; in case of delay, complaint must be made within 21 days from date the baggage was delivered. See tariffs or conditions of carriage regarding non-international transportation.

8. This ticket is valid for carriage for one year from date of issue, except as otherwise provided in this ticket, in carrier’s tariffs, conditions of carriage, or related regulations. The fare for carriage hereunder is subject to change prior to commencement of carriage. Carrier may refuse transportation if the applicable fare has not been paid.

9. Carrier undertakes to use its best efforts to carry the passenger and baggage with reasonable dispatch. Times shown in timetables or elsewhere are not guaranteed and form no part of this contract. Carrier may without notice substitute alternate carriers or aircraft, and may alter or omit stopping places shown on the ticket in case of necessity. Schedules are subject to change without notice. Carrier assumes no responsibility for making connections.

10. Passenger shall comply with Government travel requirements, present exit, entry and other required documents and arrive at airport by time fixed by carrier or, if no time is fixed, early enough to complete departure procedures.

11. No agent, subcontractor, servant or representative of carrier has authority to alter, modify or waive any provision of this contract.

GOVERNMENT FEES

Amounts shown in your receipt under tax/fee/charge concern taxes, fees and/or charges imposed by government authorities and airports and do not form part of the airfare. Where space does not permit the identification of each individual tax, amounts may have been combined. In such cases each individual tax is specified in the fare calculation area. Passengers may be required to pay taxes or fees not already collected. Further information is available upon request at your local SLM office.

NOTICE OF LIABILITY LIMITATIONS

Limits of SLM’s liability (EC Regulation No. 889/2002 Article 6.2.)
1. There are no financial limits for death or bodily injury of a passenger and SLM may make an advance payment. In proportion to the suffered loss, in order to meet the immediate economic needs of the person entitled to claim compensation;

2. In the case of destruction, loss of, damage to or delay in receiving baggage, SLM’s liability is limited to 1,000 Special Drawing Rights (approximately EUR 1,230) for proven damages. If the value of your baggage is greater than this limit, please be advised to declare a value for checked baggage in excess of the applicable liability limits at check-in or ensure that your baggage is fully insured prior to travel;

3. In the case of damage occasioned by delay in the carriage by air SLM’s liability is limited to 4,150 Special Drawing Rights (approximately EUR 5,100) for proven losses and costs.
